MLA Full Form – Member of the Legislative Assembly

A Member of the Legislative Assembly (MLA), is a representative elected by the voters of a state constituency to the state legislative assembly of a sub-national jurisdiction.

 

 

A person, provided he is qualified, is elected as an MLA on the basis of universal adult suffrage by an electorate consisting of all citizens above the age of 18 of that state or UT.

Out of the 28 states and 8 Union Territories According To 104th amendment act” of India, there is a legislature in all the 28 states and 3 Union Territories such as
Delhi,
Puducherry and
Jammu and Kashmir (Union Territory).

 

Those elected or nominated (by the Governors) to Vidhan Sabha (Legislative Assembly) are referred to as Members of Legislative Assembly or MLAs.

Each legislative constituency of the State or UT is represented by only one MLA.

Owing to parliamentary democracy, wherein some members of the legislature also act as the executive, some MLAs may have triple responsibilities.

It with an Act of Parliament, the seats can be fewer than 60, as such is the case in the states of Goa, Sikkim, Mizoram and the UT of Puducherry.

As outlined in the Constitution of India, the number of legislative seats in a legislature cannot be more than 500 members and fewer than 60 members.

In some states, the Governor may appoint 1 member to represent minorities, e.g. the Anglo-Indian community, if he finds that minority inadequately represented in the Legislative Assembly.

Depending on the population and other factors, each State or UT has varying numbers of MLAs, the highest being in the state of Uttar Pradesh (403) and the least in the UT of Puducherry (30).

 

The Members of a state legislative assembly comprises elected representatives from single-member constituencies during state elections through the first-past-the-post system.

 

The majority party in each assembly forms the state government, and the leader of the majority party becomes chief minister of the state.

 

 

The hereditary rulers or governors are vested with powers to dissolve their respective state legislative assemblies on the advice of the chief minister.

Usually, state elections are held simultaneously with the federal parliamentary elections, with the exception of Sarawak, and before 2004, Sabah.

Once dissolved, elections must be carried out within an interim period of sixty (60) days.

 

The state legislative assemblies are unicameral, unlike the bicameral Parliament of Malaysia.

In the 26 states and 3 union territories with a unicameral state legislature, it is the sole legislative body and in 6 states it is the lower house of their bicameral state legislatures with the upper house being State Legislative Council.

 

The State Legislative Assembly, or Vidhan Sabha, or also Saasana Sabha is a legislative body in the states and union territories of India.

 

 

an exception may be granted via an Act of Parliament as is the case in the states of Goa, Sikkim, Mizoram and the union territory of Puducherry which have fewer than 60 members.

5 Union territories are governed directly by the Union Government of India and have no legislative body.

The Constitution of India states that a State Legislative Assembly must have no less than 60 and no more than 500 members.

Member of Legislative Assembly :-

A State Legislative Assembly may be dissolved in a state of emergency, by the Governor on request of the Chief Minister, or if a motion of no confidence is passed against the ruling majority party or coalition.

He or she may not be a Member of Parliament and Member of the State Legislative Council at the same time.

 

To become a member of a State Legislative Assembly ( voters’ list of the state for which he or she is contesting an election.

 

A State Legislative Assembly holds equal legislative power with the upper house of state legislature, the State Legislative Council, except in the area of dissolution of state government and passing of money bills, in which case the State Legislative Assembly has the ultimate authority.

Powers of legislative assemblies are given below:

If it is passed by a majority vote, then the Chief Minister and her/his Council of Ministers must collectively resign.

 

A motion of no confidence against the government in the state can only be introduced in the State Legislative Assembly.

 

 

 

In matters related to ordinary bills, the will of State Legislative Assembly prevails and there is no provision of joint sitting.

 

In bicameral jurisdictions, after it is passed in the State Legislative Assembly, it is sent to the State Legislative Council, where it can be kept for a maximum time of 14 days.

 

Legislative Assembly of the state has to power to create or abolish the State Legislative Council by passing a resolution to that effect by a majority of not less than two-thirds of the members present and voting.

In such cases, State Legislative Council can delay the legislation by maximum 4 months the “3 months in first visit and 1 month in the second visit of the bill”.

A money bill can only be introduced in State Legislative Assembly.
